In these Terms and Conditions "we, our, us, refers to Medialinkers Web Design and Hosting Services. "You" and "Client" refers to Medialinkers Web Design and Hosting service Client or buyer of any product or service offered by Medialinkers Web Design and Hosting Services.

Rejection

We reserve the right to withdraw any or all services from any client who infringes these regulations (as set out below) without notice and with immediate effect. In the event of suspending services, it is not our policy to offer a refund of any monies paid for services or any part thereof.

Refund policy

MediaLinkers 100% refund policy includes complete refund of the amount if the client is not satisfied with that stage of development. If a prototype has been accepted and client pays 40% for final development, the prototype fees becomes non-refundable, however 40% paid later can be refunded. Before requesting you for final 50% payment, your project coordinator is supposed to send you a link to review everything on our domain. Once you have reviewed this and you make the complete payment, the same copy of website would be delivered. The refund can not be claimed after the website has been delivered.
All domain and registration fees are non-refundable, in whole or in part, even if your domain name registration is suspended, cancelled or transferred prior to the end of your then current registration term. The Hosting fees is only refundable when you face a downtime of 6 continous hours or more.

Billing/Credit Card charging:

All the products and services of MediaLinkers web design and hosting service are sold through 2checkout.com. MediaLinkers will never store your credit card for auto charging or even for recurring charges. The client will have to pay MediaLinkes by entering his credit card number each time for any transactions. MediaLinkers will never bill you with hidden or undisclosed charges at any time. All the invoices and payment requests are generated only when the client has previously agreed to pay that particular amount.

E-commerce security

Where Project involves E-commerce functionality, Client must ensure that suitable arrangements are in place to maximize security levels with regard to financial and personal information relating to the users of Project. Medialinkers Web Design service has a very strict policy of securing the confidential information submitted by client during the process of Web Design and Development. However Medialinkers Web Design and Hosting service does 't take any responsibility for leakage or misuse of any information. So far, no claim or complain ever has been submitted to Medialinkers Web Design service regarding this.

Copyrights and Trade marks

Client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork furnished to Medialinkers Web Design and Hosting Services for inclusion in the Project are owned by Client, or that Client has permission from the rightful owner to use each of these elements, and will hold harmless, protect, indemnify and defend Medialinkers Web Design and Hosting Services and its sub-contractors from any liability (including legal fees and court costs), including any claim or suit, threatened or actual, arising from the use of such elements furnished by Client.

Completion Date

Medialinkers Web Design and Hosting Services and Client undertake to work together to complete Project within the timescale defined in the specification. Medialinkers Web Design and Hosting Services will inform client on project progress and will always endeavor to meet the defined milestones. Client must also supply all source materials to timescale, failure to provide source materials or respond back within 30 days of the specified timescale will be sufficient grounds for Medialinkers Web Design and Hosting Services to cancel the agreement and retain any deposits or stage payments made thus far as cancellation fees.

Ongoing Maintenance

Our free lifetime maintenance offer that applies to some of our web sites can be stopped at any time by us (when there is a good reason). We cannot guarantee when updates that are done for free will be carried out although we will make every effort that these are done as quickly as possible and usually within 24 - 48 hours.

Abuse through content

The content/idea/theme of a web site is provided by client. Medialinkers web design service can just help you in actual conceiving the idea. You agree that you will not post any material which is false, defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented, threatening, invasive of a person's privacy, or otherwise in violation of ANY law

Search Engine Ranking

Medialinkers Web Design service puts every effort to optimize your web site for better ranking in Search Engines. Delivery of web site

Uploading a web site to your Hosting account, sending files through FTP, CD or any other media is considered as delivery of web site after which the client is not eligible for a refund. By signing up with Medialinkers Web design service, the client agrees that he will clear any balance dues after the web site has been delivered.

Limitation of liability

a) Medialinkers Web Design and Hosting Services will under no circumstance be liable for indirect, special, or
consequential damages including any loss of business, revenue, profits, or data in relation to your use of the
Web site.
b) In purchasing domain names on behalf of the client, Medialinkers Web Design and Hosting Services are acting solely as the clients agent and accepts no responsibility for the continuance or otherwise of that registered domain name.

Charges

a) Medialinkers Web Design and Hosting Services Web Design reserves the right to levy extra charges if
additional unexpected time is expended on the creation of the site, or loading of the site onto the internet, due to circumstances beyond our control or due to working with material created and/or provided by a third party.
b) Domain name registration fees, and all the services available on our Additional services page are non-refundable once the order has been placed.

Web site Credits

At the bottom of each page of the client’s web site will be placed a Medialinkers Web Design logo and the words “This web site designed, created, hosted and maintained by Medialinkers Web Design” or similar will be shown and a link to the any web site owned by Web Design web site will be active. The clients of Medialinkers Web Design service don't have rights to get this removed in any form. In case the the credits are found to be removed from a web site, Medialinkers will cancel the contract of free life time after sales service/support and take a legal action. Please note that this credit link also services as your first link exchange between Medialinkers (on its portfolio) and your web site This helps us and our clients get a better ranking on Search engine specifically for Google.

Service and Product Rates

All Client Order’s require an advance payment of a minimum of ten (10%) percent of the project proposal before any work on prototype is started. Thereafter, forty (40%) percent shall be paid before the start of final design and development and the remaining 50 (50%) percent of the Client Order total will be due upon release of the Final Pages. Medialinkers Web Design and Hosting Services reserves the right, subject to (30) days advance email notice to the Client, to change the rates charged for any ongoing maintenance services provided to Client. Medialinkers Web Design and Hosting Services must receive payment prior to final release of the Client Order.

Free Prototypes

In case a representative has officially offered you free prototypes, no money is required up front for our web design work. We create multiple mock up "test designs" of a proposed web page. If you are not happy with these designs you can walk away without paying a penny! If this is the case you will not be permitted to use any of the images, logos or design elements created by us during this stage.

Acceptance

Where Web site design or other Programming Services are supplied, Customer will notify Medialinkers Web Design and Hosting Services of any errors or omissions for rectification within a period of 7 days from Delivery. After 7 days from Delivery, Customer is deemed to have accepted that the Delivery is provided to an acceptable level of quality and further changes will be chargeable.

Commencement

Medialinkers Web Design and Hosting Services cannot always guarantee to start work on web design projects immediately. If this is the case it will be discussed with the client before any work is started. All reasonable efforts will be made to work to client time scales.

Backups and Data loss

Your use of the service is at your sole risk. We are not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on our servers.

Cancellation

Medialinkers Web Design and Hosting Services reserve the right to cancel an account at any time.
a) If the client delays commencement of work for more than 30 days from payment of the deposit Medialinkers Web Design and Hosting Services reserves the right to make a surcharge to cover additional time and price increases since the original quote.
b) In the event of a dispute regarding the design of the web site or withheld or late payment Medialinkers Web Design and Hosting Services reserves the right to withhold or withdraw all web pages and image files until such dispute is resolved.

GOVERNING LAW AND JURISDICTION

This Agreement will be governed by the laws of Pakistan where the development and designing is carried, and any user of the our service hereby agrees to be bound exclusively by the jurisdiction of Pakistani courts without reference to rules governing choice of laws.

Medialinkers Web Design reserve the right to change any part of this agreement without notice and your use of the Web site will be deemed as acceptance of this agreement. We advise users to regularly check the Terms and Conditions of this agreement. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck out and the remaining provisions shall remain in force.
